Abstract:Sexual harassment has been a serious problem in our society.In United States,sexual harassment is considered as sex discrimination.In Taiwan province,the concept of sexual harassment has been defined clearly,and the special characteristic is that sexual harassment has been brought into employment category directly,the encroachment cased by sexual harassment in workplace is a kind of infringing upon the right of work environment,it has historic significance in labor legislation.The system of opposing sexual harassment has been established in Taiwan Province.In order to opposing sexual harassment in workplace,we ought to set up the institution of the right of work environment in our labor legislation or labor contract,and also establish the institution of civil torts in civil law or civil code.
