Abstract Giorgio Agamben， the famous Italian political philosopher and thinker， has studied Franz Kafka a lot and often discussed about him in various types of essays， with the long essay “K” written especially about Kafka. In order to explore and analyze Kafka's novels， Agamben begins with linguistics， closely combines with legal philosophy， frequently enters the field of theology， and draws some brand new conclusions with the focus on the protagonist K in Der Porcess and Das Scholss. In his view， linguistic analysis is both the research method and the direct proof. Roman Law is the core of linking Agamben with Kafka. Theology is what both Agamben and Kafka think and concern about. It's meaningful and interesting to read Kafka through Agamben， or understand Agamben through Kafka. Obviously， the harvest of this new approach won't be only limited to expand and deepen the thinking and exploration on Agamben and Kafka.
