| What Kind of Law Does Chinese Education Need? |

Abstract The support and guarantee for the education development is needed from corresponding legislation. However, China’s educational law system is not yet sound, the legislation work is still heavy, the quality of the law and the response capability need to be improved. Compared to the 1980s and 1990s, there exist big differences in the aspects as the China’s economic system, main contradiction, stage of social development, the process of the rule of law, administrative concept and the consciousness of rights safeguarding. The educational law is required to respect the choice to accelerate the market economy development, promoting the education equality is needed because of the contradiction of imbalanced development, the era of moving toward the rights calls for the law to strengthen the rights protection, the concept of administration according to law requires it to effectively restraint the public power, the social transformation calls for the law to face various social issues, and the upsurge of people’s rights protection consciousness needs the law to resolve disputes in an effective manner. Hence, education legislation should take this as the basic idea.
