Abstract:Public education units are the main body of the administrative power in education. Article 15 of the Supervision Law includes the administrative and other personnel performing public duties in public education units into the scope of supervision objects,so as to realize the full coverage of all of those who exercise the public power in education. Because the legal provisions are too general, the connotations are not clear and the identification standard is missing, it is difficult to identify the classification and scope of the supervision objects. Therefore, we should start with the legislative purpose of a thorough coverage of supervision, clarify by a normative analysis the connotations of the core elements in the identification of the supervision objects in public education units, analyze the boundary and institutional logic of the exercise of public power in education from the legislative perspective, and build a multi-level system of identification standard, the contents of which is “identity+position/responsibility” and “public behavior”, in order to clear the theoretical confusion and solve the practical dilemma in the identification of supervision objects.
