Operation of Village Self-governance and Regional Characteristics in China——An Analysis Based on Data from A National Sampling Survey
With nearly 20-year development,how about the implementation of village self-governance system in China? The findings,according to correlation and regression analysis of this paper are: of the factors effecting village self-governance,geographic location,regional types and traffic situation haven't obvious impact,but economic factors have significant effect.Results show that degree of village self-governance in eastern area is a little higher than other areas,which is inclined to "sea election",where its financial affairs opening has short cycles and the village branch secretary of the Party is in control of the authority of finance in most villages.It also provides evidence for positive correlation between economy development and democracy development in some degree.

After the implementation of China rural autonomy system,rural elites and villagers have been given a legal political resources of governing village,and become an important factor to decide whether village governance can suceed.The rural elites-governance are the leaders that the villagers elect,decide the direction of village development,while the villagers are decisive force to carry out village governance,play the main role in the goal of village governance.Through the dynamic research of village governance,The article explores the village governance mode that the elite-lead organically combined with villager-participation from the relation of elite-authority and democratic participation.

Legal principles reflect the values and spirits of law.How to apply principles depends on the concrete situation of rules in a particular case.When there is a rule in a particular case,the principle helps to keep a rule from being misused.If there isn't a rule,the judge can use a principle to supplement the gap in law.When a principle conflicts with a rule or another principle,the judge needs to balance the weight of every principle and chooses more important principle.The balancing should abide by the proportion rule.Moreover,the judge must justify the balancing.Only the balancing accords to the proportion rule,can it be rational.

An Analysis on the Maintenance Characteristics of University Invented Patents with Different Patent Owners
University invented patents may have different patent owners,and they all have to be maintained to be effective patent rights.This paper,based on a random sample of all university invented patents in the past 21 years,examines the maintenance characteristics of patents of different owners.Practical and policy implications of the findings are also discussed in the paper.

On the Procuratorial Supervision in Criminal Proceeding
The procuratorial supervision in criminal proceeding,as the most striking expression of the legal authority of procuratorate,is a legal system throughout the whole criminal proceeding.But for quite a long time,this system is in an awkward position in legislation,which no doubt weakens in practice the supervision to certain extend,thus leading to unsatisfactory results.This paper is to give a systematic study on the procuratorial supervision in criminal proceeding based on its practical operation.We propose that reconstruction on procuratorial supervison in criminal proceeding is required so as to promote procuratorial supervison in criminal proceeding and to help regulating procuratorial practice.

The Measurement and Improvement of the Rural Land Property Right Structure of China: Based on the Analysis of the Seventeen-Province Rural Land Sample Surveys in 2001 and 2005
This article is based on the seventeen-province rural land sample surveys conducted by Renmin University of China(RUC,China) and the Rural Development Institute(RDI,America) in 2001 and 2005 in China,from which we acquire a lot of data about Chinese rural land property right and take an analysis.Four main components of rural land-use right,the stability of land-use right,land assignment right and the right to benefit from land are abstracted and given different marks for the convenience of the analysis on rural land analysis.The empirical research result shows that the integrity of Chinese rural land rights in areas of northeast,western,middle part and east declines in turn,the condition of which is not optimistic and affected by many factors.

On Modern Rickshaw Pullers'''' Group Consciousness
The rickshaw puller is a new professional community of lower classes in city which appeared following the human-driven cart's spreading.This community constituted by the urban poor,farmers entering city and other unemployed persons.Its population was multitudinous.It had the characteristics of low quality,fluidity,dispersivity,etc.They formed the primary group consciousness,such as the colleague consciousness,fellow villager consciousness,and poor person consciousness,through weak relation and the outside comparison.After the intellectual circle's initiation and the Communist Party's education,their group consciousness had promoted to a high level of class consciousness and national consciousness.They had waged the positive struggle for proletariat's liberation and guarded national and nationality's benefit.The article pointed out that,the promotion of rickshaw puller group consciousness depended on this social class' approval,society's admission,the national help,and depended on intellectual circle's initiation,instilling and raising.The social question bought by the rickshaw puller needed the entire society's more understanding,sympathy,concern and guidance to solute.

In modern Wuhan,stevedore's population was multitudinous,and the wharf labor dispute frequently occurred,which had had the enormous influence to Wuhan social economy.By combining the situation of Wuhan wharf labor dispute during 1927-1937 year,this article plans to analyze its characteristic,which was different from the general labor dispute,and inquires how the foremen participated in and operated the wharf labor dispute,then inspects the profound influence on the economic and society of modern Wuhan economic society.The article thought that the contradiction between the feudalism domination of the wharf work power and the free employment principle of Capitalism is the root of the wharf labor dispute in modern Wuhan.

On the Study of Laozi(老子)by Gu Huan
When Gu Huan explains the Laozi,he definitudes the character of Dao from noumenon theory,not have or not nonexistence,and expounds the relationship between the Dao and the substance on the bridge of Qi.Besides,he makes the Dao come back to people according to the conception of God.His politics philosophy is on the core of inaction and emphasizes the important function of convert.He points out that the Dao of heaven constantly gives kindness,helps people to perfect their wishes,and doesn't further their vice.His statements on preserving health have two main points.The first one emphasizes the practise of the ascetics is an initiative process,and the individual should consciously gain in the Dao.The second one advocates the value of life fiercely.In the development of Daoism double metaphysics in the Eastern Jin,the Southern-Northern Dynasties and the Sui and the Tang Dynasties,Gu Huan is a connecting link between the preceding and the following.

Open Nationalism——On the Stand of Modern Chinese Literary Criticism
The establishment of modern Chinese literary criticism is based on the introduction of 20th century western literary criticism theories and methods,whereas people hold different views as to how to regard the spread of western literary criticism in China.The paper proposes the stand of "open nationalism" when discussing about the relations between modern Chinese literary criticism and western literary criticism.It starts with redefining the concept of "nation",and argues that it is characterized by relativity under the context of globalization.Nationality is closely related to universality,and the development of the nation lies in negation and regeneration.Then it elaborates on the basic meaning of open nationalism,that is,acknowledging national differences and sticking to the principle of tolerance.While introducing western literary criticism into Chinese context,we should fully understand its complexity as the product of heterogeneous cultural context and experience,and be aware of its revolutionary influence upon Chinese literary criticism.Modern Chinese literary criticism adopts neutralization and harmony as its strategy,which advocates listening to different voices of others with tolerant mind,multiple value standards and conversational stance.Chinese literary criticism in the future should learn from the advantages of different cultures and apply them to the study and examination of national literary issues,highlighting its national awareness and national characters.

Language Analysis and Critical Study of Chinese Poetics
For disproving the occidental bias of describing Chinese as pictographic,and changing the studies of Chinese poetics from impressional,subjective mode into serious,objective mode,James J.Y.Liu critically discussed various aspects of Chinese poetry language by consulting academic discourse of New Criticism.In this course,he wasn't restricted the ready-made theories of Empson etc,but testified the characteristics of Chinese poetry language adequately by combining the studies of language with the studies of social context and cultural tradition.He considered that both the language analysis and poetics concept research could jointly provide the stable base of methodology of Chinese poetics.And his work would help us discussing the methods and modes of Chinese poetics studies fundamentally.

Fiscal Decentralization and the Development of Vocational Education
The theory of fiscal decentralization states that fiscal decentralization can improve the efficiency of production in local public goods,and it increases the participation of various stakeholders in the decision making process.But the proposition is strictly.Through analyzmg the course of fiscal decentralization reform and the situation of development of vocational education,we find that the conditions don't fit to the Model of Tiebout in China because of our development of society and economy,so do political institutions.So fiscal decentralization didn't improve the efficiency in local government's developing vocational education and didn't foster local stakeholders participating in the decision making process of vocational education development.The development of vocational education has many difficulties,especially in fund.So in order to adjust the cost and benefit of vocational education in different areas and foster harmonious development of vocational education to satisfy the need of vocational education in different areas,we should use the coordination role of centre government,which doesn't exist in federal state.
